Welcome to JeevaFashions! The terms "we", "us" and "our" refer to JeevaFashions. JeevaFashions operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). JeevaFashions is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Section 1 - Access and Account

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or are accessing the Services under the supervision of a parent or legal guardian.

To use the Services, including browsing our store or purchasing our products, you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 - Our Products

We make every effort to provide an accurate representation of our products in our online store. However, please note the following:

• Colors and appearance may differ from your screen. Product appearance may vary due to your device, screen settings, and lighting conditions.
• Some product images on our Website are AI-generated for presentation purposes. As a result, there may be minor variations in design, color, shade, or finish between the image shown and the actual product received. Such variations are a natural result of this presentation method and do not qualify as damage or defects for return purposes.
• We do not warrant that the appearance or quality of any product purchased will exactly match how it is depicted or rendered on the Website.
• All product descriptions, pricing, and availability are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, region, or jurisdiction.

Section 3 - Orders

When you place an order, you are making an offer to purchase. JeevaFashions reserves the right to accept or decline your order for any reason, at our discretion. Your order is not accepted until we confirm acceptance via order confirmation email or message. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order is accepted. If we decline, modify, or cancel your order, we will attempt to notify you using the email, billing address, or phone number provided at checkout, and any amount paid will be refunded in full.

You represent and warrant that your purchases are for your own personal or household use, and not for commercial resale or export.

Returns and replacements are subject solely to Section 4 below (Returns & Damage Claims) — we do not offer a general returns or exchange policy beyond what is set out there.

Section 4 - Returns & Damage Claims

We want you to be confident in your purchase. Our return policy is limited strictly to genuine cases of product damage:

• Returns or replacements are accepted only if the product is received damaged or defective.
• Any such claim must be raised within 3 days of delivery, along with photo or video proof of the damage and your order number, sent to fashionsjeeva@gmail.com.
• Claims raised after 3 days of delivery will not be accepted.
• We do not offer returns, replacements, or refunds for change of mind, incorrect size or style selection, or minor variations in color/design — including variations arising from AI-generated product imagery as described in Section 2.
• Products must be unused, in original packaging, and with tags intact (where applicable) to be eligible for a damage-related return.
• Once a damage claim is verified by us, we will offer a replacement or refund at our discretion.

Section 5 - Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation. All prices are listed in Indian Rupees (INR). Unless otherwise stated, posted prices do not include applicable taxes, shipping, handling, or customs/import charges, which will be added at checkout where applicable.

Prices in our online store may differ from prices in any physical or third-party stores. Promotional offers may be governed by separate terms; where those conflict with these Terms, the promotion's terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update this information (including email address and payment details) so we can complete your transactions and contact you as needed.

You represent and warrant that: (i) any payment information you provide is true, correct, and complete; (ii) you are duly authorized to use the chosen payment method; (iii) charges incurred by you will be honored by your bank or payment provider; and (iv) you will pay all charges incurred at the posted prices, including shipping/handling and applicable taxes.

Section 6 - Shipping and Delivery

We aim to dispatch and deliver orders within the timelines communicated at checkout or in your order confirmation. However, all delivery times are estimates only and are not guaranteed.

We are not liable for delays caused by shipping carriers, customs processing, weather, or other events outside our control. Once we transfer products to the delivery carrier, title and risk of loss passes to you. Please ensure your shipping address and contact details are accurate — we are not responsible for non-delivery or misdelivery resulting from incorrect information provided by you.

Section 7 - Intellectual Property

Our Services — including trademarks, brand name, text, displays, images, graphics, product photography, and the design and arrangement thereof — are owned by JeevaFashions, its affiliates, or licensors, and are protected under applicable Indian and international copyright, trademark, and intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants any license or right to you under any patent, trademark, copyright, or other intellectual property of JeevaFashions, Shopify, or any third party, except as expressly stated. All rights not expressly granted are reserved by JeevaFashions.

JeevaFashions' name, logo, product names, designs, and slogans are our trademarks or those of our affiliates/licensors, and must not be used without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks on the Services belong to their respective owners.

Section 8 - Optional Tools

You may be given access to customer tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available," without warranties or endorsement of any kind, and we have no liability arising from your use of them. Use of any optional third-party tool is entirely at your own risk and discretion; you should review and understand the third party's own terms before use.

JeevaFashions is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with JeevaFashions. By using the Services, you acknowledge that Shopify is not responsible for any aspect of the sales between you and JeevaFashions, including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with JeevaFashions.

Section 11 - Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and other third parties, which may be located in other countries, in order to provide services to you.

If you submit any ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose, including commercial use. You represent and warrant that: (i) you own or have all rights necessary to submit the Feedback; (ii) you have disclosed any compensation received in connection with it; and (iii) it will not violate any third-party right (including copyright, trademark, or privacy) or contain unlawful, abusive, or malicious content. You may not use a false identity or mislead us or third parties as to the origin of any Feedback. You are solely responsible for your Feedback and its accuracy.

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change, update, or cancel orders if any information is found to be inaccurate, at any time, including after an order has been submitted.

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you have violated these Terms.

Section 15 - Automated Agents

This section applies if you use, allow, or cause the deployment of an "Agent" — any software that takes autonomous or semi-autonomous action on behalf of a person without direct supervision — to access or interact with our Services.

No Agent may access or interact with the Services unless it: (i) identifies itself as an Agent in all requests (e.g., via the user agent string); (ii) does not conceal that it is an Agent or mimic human behavior to bypass bot-detection measures such as CAPTCHAs; (iii) responds truthfully to any prompt asking whether it is human or automated; and (iv) does not circumvent any measure intended to control how Agents access the Services. We may restrict or block Agent access at our discretion, including by technical measures.

To the fullest extent permitted by applicable law, JeevaFashions, our partners, directors, officers, employees, affiliates, agents, and service providers — as well as those of Shopify — shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits or lost data, arising from your use of the Services or any product procured through them, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. Our total liability in any case shall not exceed the amount paid by you for the specific order giving rise to the claim.

Section 19 - Indemnification

You agree to indemnify, defend, and hold harmless JeevaFashions, Shopify, and our respective affiliates, officers, directors, employees, and service providers from any losses, damages, liabilities, or claims (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any law or third-party right; or (3) your access to or use of the Services.

We will notify you of any indemnifiable claim; failure to promptly notify will not relieve your obligations unless you are materially prejudiced by the delay. We may control the defense and settlement of such claims at your expense, but will not settle any claim requiring non-monetary obligations from you without your reasonable consent. You agree to cooperate in the defense of such claims.

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed, without affecting the validity of the remaining provisions.
